Terms & Conditions of euroway.pl

1. General Information

The website euroway.pl (the “Website”, the “Platform”) and related services are made available to users under these Terms & Conditions (“Terms”).

The Website www.euroway.pl is owned and operated by EUROWAY INVEST SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered seat in Borzyszewo (Borzyszewo 38, 72-300 Gryfice, Poland), entered into the Register of Entrepreneurs of the National Court Register (KRS) under number 0001187270, VAT ID (NIP) PL8571943058, REGON 542385233.

By using the Platform, you agree to be bound unconditionally by these Terms. We reserve the right, at our sole discretion, to update or modify these Terms at any time. Continued use of the Website after any changes have been published means that you accept those changes. If applicable law does not allow certain provisions to apply in whole or in part, such provisions will apply to you only to the extent permitted by applicable law.

These Terms govern the use of our website www.euroway.pl, any of its subdomains and/or any other websites operated by us or on our behalf, as well as any mobile or desktop applications developed by us or on our behalf, and other services we provide.

Before using any of our services, you should make sure that you understand these Terms. By using the services, you confirm that you accept them. If you do not accept these Terms, you must not use our services and should leave the Website immediately. Continued use of the Website or placing orders means you accept these Terms.

When we say “EUROWAY”, “we”, “us”, “our”, “Platform” or “Website”, we mean euroway.pl and, where applicable, its affiliates. When we say “you” or “your”, we mean you, the person accessing the Website and using the services offered through it.

On euroway.pl you can purchase products offered by us and/or by our commercial partners. When we refer to a “partner” or “partner seller”, we mean third-party sellers cooperating with EUROWAY, who provide inventory, product information, handle shipping and process returns of products purchased through the Website. You purchase products through EUROWAY, and we facilitate all necessary communication between you and the partner sellers.

The display of products on the Website does not constitute an offer in the legal sense; it is an invitation to treat. A binding sales contract is only concluded once you receive an order confirmation from us.


2. Use of the Platform

(a) The Website www.euroway.pl is generally available 24 hours a day. Occasionally, it may be temporarily unavailable due to maintenance or technical work. Orders can only be placed when the Website is available.

(b) To place an order through the Platform, you must be at least eighteen (18) years old and have a valid payment method accepted on euroway.pl. If you are under 18, you may only place an order with the consent of a parent or legal guardian or if you are otherwise legally authorised to conclude the contract.

You confirm that all information you provide on the Platform (including personal data and payment details) is true, accurate, up-to-date and complete, that you are at least 18 (or act under proper consent/authority), that you are authorised to use the selected payment method and that the relevant account contains sufficient funds to cover the cost of your order.

(c) EUROWAY takes reasonable measures to keep your personal data, including order and payment details, secure. However, we are not liable for any loss or damage you may suffer if a third party gains unauthorised access to any data you provide when accessing or using the Platform, where such access occurs for reasons beyond our reasonable control. (d) By completing the checkout process and placing an order, you submit to EUROWAY an offer to purchase the selected products. All orders are subject to product availability, price confirmation and acceptance of the order. We may be required to cancel all or part of an order if a product is unavailable or is available at a different price than presented (for example, due to an obvious error).

(e) You may only place orders as a consumer – a natural person acting for purposes not directly related to their business or professional activity. We do not provide B2B sales (such as invoices for business entities), unless explicitly stated otherwise. By placing an order, you declare that you are acting as a consumer.

(f) If an ordered product has been cancelled or returned, EUROWAY may, at its sole discretion, send you suggestions of alternative products available on the Platform.


3. User Account

(a) Access to some features of the Platform may require registration and the creation of a user account (the “Account”).

(b) As part of the registration process and using your Account, you may be asked to provide, among others: your name, e-mail address, password, delivery address, billing address, phone number, payment details and other information necessary for proper account and order handling.

(c) You are solely responsible for:

  • keeping your login and password confidential and secure; and

  • all activities carried out through your Account, whether or not authorised by you.

(d) You agree to provide always true, accurate, and up-to-date information. We may request additional documentation or information to verify your data, and may limit or suspend access to your Account if the information is incomplete or manifestly incorrect.

(e) After successful registration, we may, at our discretion, activate your Account and grant you access to the Platform’s features.

(f) We may suspend or cancel your Account if you breach these Terms, applicable law, or generally accepted principles of good conduct, or if we have reasonable grounds to suspect fraud or misuse.

(g) We are not liable for any losses resulting from your failure to secure your login credentials or Account.

(h) You agree to indemnify and hold EUROWAY harmless from any claims or damages resulting from your provision of untrue, incomplete or misleading information.

(i) You may delete your Account at any time using the appropriate function in the user panel or by contacting us from the registered e-mail address at helpmyeuroway@gmail.com.

(j) We reserve the right to terminate your access to the Website, in whole or in part, at any time, for valid reasons, in particular in case of breach of these Terms. If you have paid for products that you do not receive due to such termination without your fault, we will refund the relevant amounts.


4. User Obligations

You agree, in particular, to:

(a) not intimidate, harass, impersonate, stalk, threaten, or endanger other users, and not send spam, bulk messages, commercial or advertising content or any unsolicited content;

(b) not share your Account with any third party and inform us immediately of any unauthorised use of your Account, password or e-mail address, as well as any other actual or suspected breach of Platform security;

(c) not use the Platform for any unlawful or fraudulent purpose and not facilitate such activities for others;

  • in particular, you must not use the Platform to offer or purchase goods or services that are illegal;

  • you must not use the Platform for any unauthorised commercial, promotional or marketing activities, unless expressly agreed with us in writing;

(d) not upload or use viruses, bots, worms, scripts, crawlers, scraping tools, or other malicious code or automated tools that may interfere with the operation of the Platform;

(e) refrain from any actions that may harm the reputation of EUROWAY or our partners, or that are contrary to our legitimate interests or the proper functioning of the Platform;

(f) not copy, reproduce, translate, adapt, modify, or publicly distribute the Platform or its content beyond permitted personal use, without our prior written consent;

(g) acknowledge that we may change the features, structure or functionality of the Platform and the range of products offered at any time without prior notice;

(h) acknowledge that information provided on the Platform (e.g. product descriptions) is of a general nature. We are not liable for decisions you make based solely on such information if they are obviously contrary to the description or intended use of the product.


5. Products and Prices

(a) All prices displayed on www.euroway.pl are shown in Polish zloty (PLN) and include VAT, unless expressly stated otherwise. Delivery costs are not included in product prices and will be shown separately during checkout.

(b) We make every reasonable effort to ensure that product details, descriptions and prices shown on the Website are accurate. However, some information is provided by third-party partner sellers, and errors may occur. If we discover an obvious error in the price of a product, we are not obliged to fulfil an order at the incorrect price and reserve the right to cancel such an order (with a full refund of any payments made). We will inform you as soon as reasonably possible if such a situation arises.

(c) Products placed in your basket are not reserved and may be purchased by other users until you complete payment.

(d) If, after you place an order, a product becomes unavailable, we will notify you and refund any amounts paid for that product. We are not liable for any additional losses caused by such unavailability, beyond the obligation to refund the amount paid.

(e) Disclaimer of Warranties
The Website, its content and all information made available through the Website are provided on an “as is” and “as available” basis, to the fullest extent permitted by law. We do not guarantee that:

  • content and information available on the Website will be free from errors;

  • the functions of the Website will be uninterrupted or error-free;

  • any defects will be corrected immediately.

(f) Any offers, discounts or promotional codes (“Promotions”) are valid only under the conditions stated for a given Promotion, and only for purchases made via www.euroway.pl. Promotions are not redeemable for cash, do not usually combine with other promotions and will not be honoured if found to be incorrectly published or not authorised by EUROWAY.


6. Payments and Taxes

(a) We may use external payment service providers (e.g. payment gateways, card processors, pay-by-link operators). Payment processing is subject to their terms, conditions and privacy policies in addition to these Terms. We are not responsible for the security or performance of the payment providers’ systems, provided we have exercised due care.

(b) You must use only your own payment instruments and keep your payment details secure. If you suspect fraud or unauthorised transactions, you should immediately contact your bank / card issuer and notify us.

(c) If any errors or mistakes arise in charging your payment method (e.g. duplicate charge), we reserve the right to correct them in cooperation with the payment provider, informing you of any such corrections.

(d) For purchases made via euroway.pl, we will issue proof of purchase (receipt or consumer invoice). The sales contract is concluded between you and the relevant seller (EUROWAY or a partner seller – as specified on the product page). Your statutory consumer rights remain unaffected.

(e) If we run any charity or donation campaigns, additional conditions for such donations (including whether they are non-refundable, and any related contests or giveaways) will be specified in separate rules or in the description of the campaign.


7. Shipping and Delivery

(a) Delivery costs are not included in the product price and will be shown separately at checkout. The delivery method and its cost may depend on the delivery address, weight, type of products and courier service.

(b) The estimated delivery time will be provided in the order summary and/or shipment confirmation e-mail. We will make reasonable efforts to ensure that your order is delivered within the indicated time. However, delays caused by factors beyond our control (e.g. courier issues, weather conditions) do not give rise to liability for damages other than the obligation to deliver the goods or refund your payment in case of contract cancellation.

(c) The delivery company may offer optional services (e.g. changing the delivery date, redirecting to a parcel shop, leaving with a neighbour). By choosing such services, you acknowledge and agree that our responsibility is limited to correctly dispatching the parcel according to the order; any further risks may be governed by your agreement with the delivery company.

(d) If a parcel is returned to the sender due to non-collection, refusal, or an incorrect address, we may charge you for the actual return costs or deduct such costs from any refund.


8. Returns, Cancellations and Refunds

(a) Under the Polish Act of 30 May 2014 on Consumer Rights, if you are a consumer, you have a 14-day right of withdrawal from a distance contract, without giving any reason, starting from the day after you or a person indicated by you receives the product.

(b) To exercise your right of withdrawal, you must clearly inform us of your decision to withdraw from the contract within 14 days of receiving the product, for example by:

(c) After notifying us of your withdrawal, you must return the product(s) without undue delay and in any event no later than 14 days from the day on which you informed us of your decision.

(d) Returned products should:

  • be unused (beyond what is necessary to examine their nature, characteristics and functioning);

  • be undamaged and complete;

  • have all tags and labels still attached (if applicable);

  • be properly packed to protect them during transport.

(e) The return address and details (including any return label, and who bears the cost of return shipping) will be specified in the order confirmation or in the return instructions on euroway.pl. You are responsible for the proper packaging and shipment of the return and should keep proof of posting.

(f) Once we receive and inspect the returned products, we will refund all payments we received from you for the returned items, including delivery costs (except any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery we offer), unless otherwise stated in the return policy. We may deduct:

  • the cost of return shipping, if under our return policy these are borne by you;

  • any reduction in the value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

(g) The refund will be made using the same payment method you used for the initial transaction, unless we expressly agree otherwise.

(h) The right of withdrawal does not apply, in particular, to:

  • goods made to your specifications or clearly personalised;

  • sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery, if so indicated for a given product.

(i) In addition to the statutory withdrawal period, EUROWAY may offer an extended return period (e.g. for the holiday season). If so, the conditions of such extended returns will be specified on the Website or in a separate “Returns Policy” section.


9. Intellectual Property

(a) EUROWAY retains all intellectual property rights to the Platform and its content, including but not limited to text, graphics, logos, layouts, images, audio and video materials, software, and downloadable files. Such content is protected under Polish and EU laws, including copyright and industrial property laws.

(b) You may make temporary electronic copies of the Platform content only to the extent necessary to view the Website on your device. You may not otherwise reproduce, transmit, adapt, distribute, sell, modify or publish the Platform or any of its content without our prior written consent, except as permitted by law for personal use.


10. Links to Other Websites

(a) The Platform may contain links to external websites. We do not control and are not responsible for the content of such websites.

(b) The inclusion of a link on the Platform does not imply our endorsement, recommendation, or approval of the linked site or its operators.


11. Security

We are not responsible for any loss or damage to your computer systems, mobile devices or other equipment arising in connection with your use of the Platform, unless such loss or damage is directly caused by our intentional or grossly negligent actions. You should take your own precautions to ensure that the process you use to access the Platform does not expose you to the risk of viruses, malicious code or other forms of interference.


12. Complaints (Defects and Warranty)

(a) Your purchase of goods as a consumer is covered by Polish consumer protection laws, including the Civil Code and the Act on Consumer Rights. This means that you may be entitled to have a defective product repaired or replaced, or to a price reduction or refund, depending on the specific situation.

(b) Defects caused by normal wear and tear, accidental damage or misuse are not considered defects under statutory warranty (“rękojmia”).

(c) Complaints regarding defects can be submitted by e-mail to helpmyeuroway@gmail.com or via a contact form on euroway.pl. We recommend including:

  • a description of the defect;

  • photos showing the defect (if possible);

  • proof of purchase.

(d) If the complaint is found to be unjustified, you may be charged the cost of reshipping the product back to you.


13. Privacy and Cookies

The processing of your personal data and the use of cookies are governed by our Privacy Policy and Cookie Policy, available on euroway.pl.

You have the right to:

  • access your personal data;

  • request rectification, erasure or restriction of processing;

  • object to processing;

  • withdraw your consent at any time (where processing is based on consent) – by contacting us at helpmyeuroway@gmail.com.


14. Newsletter Subscription

(a) By subscribing to our newsletter, you consent to receiving electronic communications (e-mail and, where separately agreed, SMS) containing marketing information about products and services offered via euroway.pl, including promotions, special offers, contests and new arrivals.

(b) You can unsubscribe from the newsletter at any time by clicking the “unsubscribe” link in any newsletter e-mail or by contacting us at helpmyeuroway@gmail.com.

(c) If we run contests or giveaways connected with newsletter subscriptions, they may be governed by separate rules, which will be made available to participants.


15. Fair Use Policy

We aim to provide all our customers with the best possible experience on our Platform. To protect other customers, our business and the environment, we reserve the right to prevent abusive or fraudulent use of our services.

If our systems detect unusual or suspicious behaviour (for example, excessive ordering and returning patterns, suspected fraud, misuse of promotions, attempts to disrupt the Platform), we may take actions including:

  • refusing or cancelling orders;

  • temporarily or permanently suspending your Account;

  • restricting your access to the Platform.

16. Governing Law and Dispute Resolution

(a) These Terms and any contracts concluded via www.euroway.pl are governed by Polish law, subject to any mandatory consumer protection provisions of the country of your residence within the EU.

(b) Any disputes should in the first instance be resolved amicably by contacting us at: helpmyeuroway@gmail.com.

(c) As a consumer, you may also use out-of-court dispute resolution mechanisms, including:

  • assistance from local consumer ombudsmen or consumer organisations;
